These Terms and Conditions ("Terms") govern your use of the Intelligrail platform, AI solutions, and related services. By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy.
1. Service Provision
Intelligrail provides AI-powered automation services, including but not limited to Voice Agents, Chat Widgets, and custom AI integrations. We reserve the right to modify, suspend, or discontinue any part of our services at any time with prior notice.
The specific scope of services, deliverables, and timelines will be defined in a separate Service Agreement or Statement of Work (SOW) executed between Intelligrail and the Client.
2. Acceptable Use Policy
You agree not to use our services to:
- Generate or distribute illegal, harmful, or malicious content.
- Impersonate individuals or entities without explicit authorization.
- Interfere with or disrupt the integrity or performance of our AI infrastructure.
- Attempt to reverse engineer, decompile, or extract the source code of our proprietary models.
5. Intellectual Property
Our Property
Intelligrail retains all rights, title, and interest in our proprietary AI models, software, algorithms, and methodologies used to deliver the services.
Client Data
You retain all rights to the data you input into our systems. You grant us a limited license to process this data solely for the purpose of providing the agreed-upon services.
3. User Accounts
Registration
When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms.
Account Security
You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password.
4. Payments and Subscriptions
Fees
You agree to pay all fees associated with your subscription plan. All fees are non-refundable except as required by law.
Billing
We will bill the fee to your provided payment method automatically on a recurring basis, depending on your subscription cycle.
7. Limitation of Liability
To the maximum extent permitted by law, Intelligrail shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of our services.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Spain and the European Union. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Madrid, Spain.
6. Termination
Termination Rights
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.
Effects of Termination
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
8. Indemnification
You agree to defend, indemnify, and hold harmless Intelligrail and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses.
